Smart Fit Ltd., Company No. 516978632 (hereinafter: "the Company") respects the privacy of its customers and all users of its services, including users of the website (hereinafter collectively: "the User" or "the Users") which it manages and operates at the address: www.speedianceisrael.co.il (hereinafter: "the Website").

 

This Privacy Policy and the Cookies Policy (detailed in Section 10 below) (hereinafter collectively: "the Privacy Policy") govern how the Company uses the information it collects about Users.

 

The information provided below is intended to help the User understand the Company's privacy policy. The Privacy Policy, as detailed below, will clarify the information the Company collects about users of its services, the purposes for which the Company collects the information, what use the Company may make of the information, which third parties the Company will transfer information to, how the Company handles and stores the information, and what the Users' rights are regarding the information collected about them.

 

The information the User provides to the Company depends on the User's consent and will, and the provision of information does not arise from a legal obligation. The information will be stored in the Company's database for the purposes detailed in this privacy policy. Use of the Website and/or the services offered by the Company indicates the User's consent to this privacy policy and that information will be stored and managed in the aforementioned database. The use of information in the database will be in accordance with the provisions of this privacy policy or according to the provisions of any law, for the purposes detailed below.. For the avoidance of doubt, it is clarified that if the User does not agree to provide information that he will be asked to provide, the Company will not be able to provide him with the services it offers.

 

This privacy policy is written in the masculine form for convenience only and should be understood as referring to the feminine form as well.

 

1.          What is information?

In this policy, the term "information" means any information collected by the Company or provided to it by the User or someone on their behalf, within the framework of the User's use of the Website or the services included therein, by which the User can be identified, and information protected by the Privacy Protection Law, 5741-1981 (hereinafter: "the Law").

2.1.             Information that the User provides to the Company, inter alia, in connection with the purchase of products on the Website;

2.2.             Information received by the Company in connection with the services provided by the Company;

2.3.             When the User requests to join the Company's mailing list (newsletter);

2.4.             Through the use of the Website, including non-identifiable information via cookies, as detailed in Section 10 of this policy.

Through correspondence and/or any other digital communication with the Company, including email, WhatsApp.

 

3.          Information the Company collects about the User  

The Company will collect the following information about Users (all or part of it):

3.2.             Phone number/mobile phone;

3.3.             Email;

3.4.             Date of birth;

3.5.             Address;

3.6.             Details and history of purchases made by the User on the Website and in branches;

3.7.             Consumer preferences of the User;

Why the Company collects the information and the use the Company makes of the information  ("the Purposes")?

3.10.           For and in connection with the provision of services by the Company or someone on its behalf;

3.28.           Furthermore, the Company uses non-identifiable information collected through various technological means, inter alia, for operating the Website, to facilitate the use of the Website, for statistical checks regarding Website usage, and more, as detailed in Section 10 of this Privacy Policy.

 

4.          Transfer of Information

4.1.             The Company will not transfer or disclose information to third parties, except as specified in the Privacy Policy. We undertake not to transfer customer credit card details to any third party.

4.2.             The transfer of information to third parties will include only relevant information that does not exceed the purposes for which the information is transferred, and will be carried out proportionally for a defined, explicit, and legitimate purpose.

4.3.             The Company may transfer the information or any part thereof to third parties in one or more of the following cases:

4.3.1.                Third parties who provide various services to the Company, including security system and information technology (IT) support services, data storage services, clearing services, website building services, survey and research services, courier and logistics companies, companies that provide advertising and marketing services, lawyers or other external professional consultants, and additional third parties who provide services to the Company in connection with its activities.

4.3.2.                If the Company receives an instruction, including a court order, to disclose the User's details or information about the User in accordance with the provisions of any law.

4.3.3.                In any dispute, claim, demand, lawsuit, or any legal proceedings between the User or anyone on their behalf and the Company or anyone on its behalf.

4.3.4.                In the event of a transfer and/or sale and/or assignment and/or acquisition of the Company and/or its assets and/or any part thereof, for consideration or without consideration, including, but not limited to, cases in which ownership of the Website and/or its content, in whole or in part, is transferred to third parties, including but not limited to, in the event of a merger of the Company and/or its activity with third parties, and including, without derogating from the generality of the foregoing, in cases of a change of control, full or partial, in the Company.

4.3.5.                If a claim is raised or the Company suspects that a user has committed an act and/or omission that may harm the Company, anyone on its behalf, or any third parties, including other users.

4.3.6.                If a claim is raised or the Company suspects that a user is using the Website to commit an illegal act and/or to enable, facilitate, assist, and/or encourage the commission of such an act.

4.3.7.                In any case where the Company deems that providing the information is necessary to prevent harm to the Company, the user, or any third party.

4.4.             The Company may transfer the information to third parties, as stated above, even outside the State of Israel, including to third parties located in countries where the level of data protection differs from the provisions of Israeli law and which may provide less protection than that provided by Israeli privacy laws. Without derogating from the provisions of this policy, use of the Website indicates the user's consent to this privacy policy, including the transfer, storage, and retention of information by third parties located outside the State of Israel.

4.5.             In addition, we note that the user's credit card details, when purchasing on the Website, are linked within an IFRAME directly to Tranzila Ltd. (hereinafter: "the Acquiring Company") for the purpose of making payment for the Company's services. It is clarified that the Company is not a party to this. The user is responsible for reviewing the privacy policy on the Acquiring Company's website before making payment. Furthermore, and without derogating from the provisions of this privacy policy, the user confirms and agrees that the Company shall not be liable for any damage of any kind whatsoever, indirect or direct, caused to the user and/or anyone on behalf of the user in connection with the retention, storage, and processing of information by the Acquiring Company, including but not limited to cases where the information is lost, exposed, or used in any unauthorized manner.

4.6.             Without derogating from the provisions of this privacy policy, the Company and anyone acting on its behalf shall not bear any liability, and is exempt from any responsibility, in connection with any damage, loss or expense, of any kind or nature whatsoever, whether direct or indirect and/or circumstantial and/or consequential, which has been caused and/or will be caused to users and/or to a third party, in connection with and relating to service providers, including with respect to the collection of information by service providers, its use, its transfer to third parties, its storage and security by service providers, and more.  

 

5.          Information Security

5.1.             The Company employs technical and physical measures concerning privacy and information security in accordance with accepted standards. As is well known, the storage and transmission of information by electronic means, including via the internet, can never be completely secure, and at any time that the user provides information to the Company, particularly via the internet, the user does so with full consent and subject to the risks involved in transmitting information in this manner.

5.2.             The Company does not guarantee that the website will be absolutely immune from unauthorized access to the information stored therein. The user has the right to access and/or correct information stored about them, in accordance with the provisions of sections 13 and 14 of the Privacy Protection Law. 12.       Applicable Law and Jurisdiction

12.1.           The terms and provisions detailed in the privacy policy, as well as any changes or amendments thereto, and the use of the website, shall be governed by the laws of the State of Israel without regard to its conflict of laws principles.

12.2.           The exclusive jurisdiction for any dispute and/or claim arising in connection with the use of the website and this privacy policy, or related thereto, is vested in the courts of Tel Aviv-Jaffa.

 

13.    Changes and Updates

The Company may, at its sole discretion, modify the Privacy Policy from time to time without the need to provide notice or warning. The most recent Privacy Policy published on the Website will be binding on the user. Continued use of the Website by the user after an update to the Privacy Policy will constitute the user's consent to the updated Privacy Policy, including any changes.
